Hey thanks. Been meaning to write a post about this, so maybe this comment will help me think it through.

So on the day that the Thomson decision was announced, two "senior administration officials" held a conference call about it. And one of them said that the administration hadn't yet made any decisions about classifying any GTMO detainees in its so-called "Fifth Category" of detainees -- those who must be held in indefinite/preventive detention bc they allegedly can be neither responsibly tried nor responsibly released.

Now. The Obama people have reviewed these cases for a fucking year. We're only talking about a cohort of about 230 people. And we're supposed to believe that they haven't found a single one of them for indefinite/preventive detention but that when they do we're supposed to believe that those dudes really are too dangerous for trial or release? This is pure venue shopping -- determining the proper venue for a politically-acceptable way of keeping these people imprisoned.

Yeah, that might be overstated. I suppose I misfired, but my point was just that we have a perniciously persistent ability, unshared by many other cultures, to convince ourselves that arbitrary dates can zero the historical balance.
