This decision by the Second Circuit that the NYPD can keep secret all its documentation about spying on Americans and making mass arrests at the 2004 Republican Convention (which cost the city millions in settlements, let's not forget) is a terrible piece of horseshit.







The best part about that opinion is the way the court so cavalierly dismisses the idea that you could have an "attorneys eyes only" confidentiality agreement where the lawyers get to look at the docs but the public does not. The court just basically says, oh well, we have no reason to believe that the lawyers will keep this confidential. Ummm, that's ALL LAWYERS DO! The main defining characteristic of a lawyer is our ability to keep and hold multiple confidences. But you know, it's not like we should be getting into the cops' private business of law enforcement. Just let them do whatever the hell they want with no oversight. Because it's worked out so well!
