Some People to Demonstrate in New York City Against Fair Trials and Democracy

The anti-American group calling itself the Florida Security Council is coming to New York City, to join with the 9/11 Families for a Safe and Strong America in a demonstration against our legal process! Because they believe we should not be better than people who hate democracy. This is a sad thing. But there are funny things amongst the sad. Are you ready to see their invitation to the demonstration?

Obviously these people are utterly stupid, but why does he have to be tried in New York City, instead of say Pittsburgh or Baltimore? Why make it this big circus?
Timothy McVeigh, e.g. - who was not a terrorist, apparently - was tried in Denver.

Because the Constitution -- we all remember that, don't we? -- says that "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed"

This can be overridden (as in McVeigh's case) by a showing that an impartial jury is not available where the crime was committed. But first they're going to have to show that NYers can't provide a fair trial. Good luck.

You beat me to it, with your "Constitution" and your "inalienable rights". I would add that the Constitution doesn't limit itself to "citizens" (see, "accused" in the passage you quote, as well as the "persons" reference in the 14th Amendment).

Also, on the side-topic of jury-shopping, I am curious why the DOJ didn't take this to the Eastern District of Virginia, where the Pentagon is located. A jury trial based on jurors from Northern Virginia (government workers, military and somewhat redneck-y folks) would be CERTAIN to approve of the death penalty, while there is a not insignificant chance that a NYC jury will go for life in prison. Or is that goal?

That's a very good question, Sigerson, and I'd be very interested in the answer. I suspect it is because the US Attorney's office in the Southern District of New York is considered (mostly by themselves) to be the "premiere" office, and they do have a lot of clout at DOJ. I'm guessing they lobbied hard to get the assignment.

Actually, the courts in NY have more experience with international terrorism cases than any other in the US. They dealt with the first WTC bombing as well as the Cole case and I think a few others? This extends to services like the NYPD, who are used to doing security lockdowns appropriate to such cases, as well as other juicy targets for terrorist attacks like UN summits and the like. Point being, in addition to having proper jurisdiction, NYC has the proper infrastructure and training for the case already in place.

You notice that the picture of KSM that you saw was almost always this hilarious one of him looking groggy and unkempt as he was being captured -- back when he was safely being detained forever in Guantanamo, but now that everyone wants you to be TERRIFIED OF HIS TRIAL, you get those scary beardy pics with the piercing eyes?

Just so you guys know with whom you're messing: When you google "Tom Trento," the second result that comes up calls him a "Citizen Warrior Hero." Which means that if he's 12th level or higher, he can cast cleric spells. Be warned.
